REMEDIES SAMPLE ANSWER
(Spring 2007)

Course Requirements & Class Participation:

The audio for Remedies will be uploaded to the website shortly after each class. You can access the audio through mslaw.edu/Onlinecourses/Remedies/Index.htm. Enter COYNE as both the username and password. Please be sure that you respond by e-mail to the five questions posted for each week’s assignment. You must respond to these questions in a timely manner as your grade is, in part, based upon your answers to those questions.

Consider the requirements of Rule 11 while you read these cases. Is it good lawyering, or just plain dishonest, to fail to attempt to give any notice on a TRO? Under what circumstances is it appropriate to use an injunction to force a speedier resolution of a case? Under what circumstances would you inform your client to intentionally violate a court order? How does a lawyer balance the need to make money on hourly fees with the client’s right to a quick settlement?

You can purchase the Remedies CD in the bookstore. The bookstore will also obtain a hard copy of the text if you pay for the printing in advance.

You are required to participate in each class, and your grade will be lowered if you choose not to participate. Please immediately email me and acknowledge your participation in this class. Please note that the final is an in class examination that is scheduled during exam week.

You are required to watch the PowerPoint presentation, complete the 103 questions and submit them to me by the semester break.

You are also required to email me your list of what the three fundamental things someone should know about the area of the law you intend to enter or about the field in which you presently work. How will you insure that as a lawyer you will always represent clients at a very high skill level? I look forward to hearing from you.

Grading Criteria

GRADE 1. Answers are not very well thought out and many important points are not addressed. Some weeks very submitted very late or not at all. It will take a lot of work in a very little time to get your act together to pass this course.

GRADE 2. While answers respond to the issues, a number of important issues are not addressed thoroughly or some answers are only a cursory response to the question posted. I think you can do better work.

GRADE 3. Good Answers: Answers recognize the issues, and properly explain the law. Answers to questions are reasonably well written and thoughts are clearly expressed. With some minor improvements this would have been much better.

GRADE 4. Well Above Average Answers: The answers address most issues and explain the relevant law. Answers are well-written, logical responses to the questions. The knowledge of the law is clearly evident. Nice work.

GRADE 5. Outstanding Answers: The answers respond to all questions in a well-written fashion. The law is explained clearly and issues are addressed in a logical manner. It is clear that the questions were clearly examined, and student put a great deal of thought into organizing answers to clearly address and respond to relevant matters. Great work.
